Agreement to these terms

This website at md2resort.com is operated by MD2 Botanic Cafe & Resort ("we", "us" or "our"). By browsing the site, sending an enquiry or making a booking through it, you accept these Terms of Use. If you do not accept them, please do not use the site.

About this website

The site describes our restaurant, chalets, seminar hall, facilities and estate tours, and lets you send an enquiry or make a reservation. It is general information for guests — it is not, on its own, a formal offer or a contract.

Using the site

You may use this site to find information about the resort and to make genuine enquiries and bookings. You agree not to:

• use the site for any unlawful, fraudulent or misleading purpose, including making a booking you do not intend to honour;
• submit another person’s details without their permission;
• copy, republish or commercially reuse our text, photographs or design without our written permission;
• attempt to gain unauthorised access to the site, its booking system or any server behind it;
• introduce malicious code, or place an automated load on the site that interferes with its normal operation.

Enquiries and bookings

An enquiry or booking request sent through this site, by WhatsApp or through the online booking system is a request, not a confirmed reservation. Your booking is confirmed only when we confirm it to you directly by WhatsApp, email or phone.

We may decline or cancel a booking where the table, chalet or seminar hall is no longer available, where the details given are incomplete or clearly incorrect, or where the request cannot be met safely.

You are responsible for giving us accurate contact details, arrival times and guest numbers, and for telling us in advance about dietary needs, accessibility requirements or anything else we need to prepare for.

Prices, deposits and payment

Prices shown on this website are in Malaysian Ringgit and include applicable taxes and charges unless stated otherwise. Package prices may depend on the number of guests, the season and the day of the week.

We work to keep prices current, but they can change. The price we confirm to you for your booking is the price that applies to it.

Some bookings — in particular chalets, the seminar hall and large groups — need a deposit to hold the reservation. Payment terms are confirmed together with your booking. Card and banking details are handled by our payment provider and are not stored on this website.

Changes, cancellations and no-shows

If you need to change or cancel a confirmed booking, please tell us as early as you can. The cancellation and deposit terms given to you when the booking was confirmed are the ones that apply.

We may occasionally need to change or cancel a booking ourselves for reasons beyond our reasonable control — severe weather, flooding or a landslip on the access road, a power or water failure, illness affecting our team, or a government order. If that happens, we will offer you an alternative date or a refund of what you have paid for the affected booking.

While you are at the resort

The resort sits on a working pineapple estate on a hillside. When you visit, you agree to:

• follow the signs, safety instructions and directions given by our team;
• keep to guest areas and marked paths, and stay clear of the plantation, machinery and back-of-house areas unless you are on a guided tour;
• supervise the children in your group at all times, in particular around the pool, terraces, slopes and access road;
• drive slowly and park only in marked areas — the access road is steep and shared with estate vehicles;
• treat our team, our other guests, the buildings and the plantation with respect.

We may ask a guest to leave, without a refund, for behaviour that is unsafe, unlawful or seriously disruptive to other guests.

Photography and filming

You are welcome to take photographs and video for your own personal use. Commercial photography, filming, drone flights and pre-wedding or event shoots need our permission in advance and may be chargeable.

We sometimes photograph the resort and its events for our own website and social media. Tell our team if you would rather not appear, and we will do our best to keep you out of frame or to remove the image.

Our content

The text, photographs, layout, logo and design of this website belong to us or are used with permission, and are protected by copyright and trade mark law. You may view and print pages for your own use, and share links to them. Any other use — copying, adaptation, republication or commercial use — needs our written permission.

Accuracy and availability

We take care to keep this website accurate, but menus, packages, facilities, opening hours and images may change, and particular dishes or rooms may be unavailable. Photographs are of the resort but are illustrative — the view, weather, crop and seasonal decoration will differ on the day.

We do not promise that the site will always be available or free of error, and we may suspend or change any part of it without notice.

Other sites and services

The site links to and embeds services we do not control, including Google Maps, WhatsApp, our social media pages and our online booking system. We are not responsible for their content, availability or terms, and your use of them is governed by their own terms and privacy policies.

Our responsibility to you

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under Malaysian law.

Subject to that, we are not liable for loss arising from your reliance on general information published on this website, from the site being unavailable, or for indirect or consequential loss such as lost profit, lost time or a missed onward arrangement. Our liability in connection with a booking is limited to the amount you paid us for that booking.

You remain responsible for your own property while at the resort, and for any damage caused by you or by your group.

Privacy

How we handle your personal information is set out in our Privacy Policy, which forms part of these terms.

Changes to these terms

We may update these terms from time to time. The version published on this page at the time you use the site is the version that applies, and the date it was last updated is shown at the top of the page.

Governing law

These terms, and any dispute arising out of them or out of your visit, are governed by the laws of Malaysia and are subject to the exclusive jurisdiction of the Malaysian courts.
